Prominent Charleston Attorney Popped On DUI, Drug Charges – FITSNews

LAWYER, TV ANALYST ARRESTED. One of the most prominent attorneys in the South Carolina Lowcountry was busted for driving under the influence and drug possession over the New Year’s holiday. Mark Peper of the Peper Law Firm in Charleston, S.C. was arrested early Monday morning and charged with DUI, open container and cocaine possession, according to Charleston County jail records. He refused a field sobriety test, according to police, and allegedly told the arresting officer that the pants he was wearing containing trace elements of cocaine belonged to his brother. The 38-year-old lawyer was booked shortly before 2:00 a.m. EST at Charleston’s Al Cannon Detention Center and released on his own recognizance after posting a nearly $5,000 bond on the three charges. In addition to running ads all over the region for his successful law firm, he has appeared as an analyst on the Lowcountry’s most widely viewed television station, WCSC TV-5. Obviously this website has a different view than most establishment media outlets when it comes to recreational drug use, but Peper’s decision to get behind the wheel of a car while impaired – if that’s indeed what happened here – is most disappointing. Thankfully, no one was injured as a result of his carelessness – and our hope is that he will learn his lesson and get his life back on track quickly.

Driving under the influence means operating a motor vehicle after consuming alcohol or drugs that have impaired a person’s mental or motor skills. In most states, a person will be considered “Impaired” if they exhibit objective signs of intoxication, or if they have a blood alcohol content of.08 or higher. Many states also have zero tolerance laws for drivers under 21, where any non-zero BAC level constitutes an offense. Most states also hold commercial drivers, such as truck drivers, to a more rigorous standard. Law enforcement officers use a variety of tests, such as field sobriety tests and breathalyzers, to determine whether a driver is impaired by alcohol. In some jurisdictions, you have a right to refuse some of these tests, but in other jurisdictions you may be required to submit to them. It is important to know the law in your particular state, and to consult a DUI attorney if you are facing charges. DUI lawyers are criminal defense attorneys focused on representing clients facing DUI/DWI/OWI charges. An experienced DUI lawyer will be able to evaluate the case against you and present your options on how to best limit the impact of the charges against you. DUI lawyers also handle related cases such as driver’s license reinstatement and DUI record expungement. Blood Alcohol Concentration: The percentage of alcohol in a person’s blood. Field Sobriety Test: Any one of several roadside tests that can be used to determine whether a driver is impaired.

Now no one wants to fight a losing battle but if you do not try to muster up a fight you already lost and you will lose for sure. Do not underestimate the power of a fantastic legal pro; they can be just as innovative and dedicated as Ross and his team. The latter used weapons, a DUI lawyer in Charleston, SC will use the power of their mind and the pen. If there is any way that you could still fight the charge by at least have the consequences reduced if not completely dismissed, then you can rest assured that your DUI legal pro will be the first person to tell you everything about it. Pleading guilty is better for multiple reasons in such cases, say illustrious DUI lawyers in Charleston, SC. To begin with, you might be able to strike a plea bargain by pleading guilty and save a substantial amount of money by not going into trial in terms of legal fees and court fees. When it comes to assessing the strength of the case that the prosecution has against you and your odds at beating the charges, your South Carolina DUI attorney will usually be the best judge of that given his or her professional expertise and experience in this field. Usually, we can say that it is likely that you will be convicted of your charges under the following circumstances. The maximum BAC limit in most states is 0.08% BAC. In cases where your BAC turns out to be exactly 0.08% or just marginally above that number then it is possible to challenge the accuracy of the breathalyzer and have this evidence dismissed in such a way. If your BAC was two or three times over the legal limit there really is no argument you or your legal counselor can put up against that in most cases. You and your legal representative can go after the charges via probable cause. Apart from the result of the breathalyzer test, if you also happen to be facing concrete evidence such as multiple witness testimonies, arresting officer testimony, sobriety test results, toxicology test results, blood or urine test results and all of the evidence point to the fact that you were under the influence, then it may not be very easy to disprove your case. This would be a good time to plead guilty, suggest Charleston, SC DUI lawyers. The best step that anyone who is arrested and faces DUI charges can take is to appoint a South Carolina DUI lawyer the next day or perhaps later on that day. Your legal professional will make sure that no matter what the specifics of the case, you get the best possible outcome.
