For a DUI 1st conviction, without accident or injury to others, you will lose your license for 6 months, subject to getting a provisional license. If from out of state, a conviction or plea will be forwarded to your “Home state” where other penalties may apply under their laws. Depending on your”blood alcohol level,” you will pay a fine, perform community service, enroll in an “alcohol and drug safety action program, and be required to maintain SR-22 insurance for 3 years, even if you do not own a vehicle. Subsequent DUI convictions will result in even more serious penalties and fees. Any DUI arrest involving an accident with serious injury or death becomes a felony. DUI vs. DUAC. Everyone has heard of a DUI charge. In South Carolina, you can be arrested or sometimes plead to a DUAC. While many believe this is a “Lesser charge,” it is not. The penalties are the same as a DUI. The only advantage of pleading to a DUAC is the ability to say you were originally arrested for DUI but pled to DUAC at your lawyer’s urging. For a second BUI conviction or plea, the fine increases to $2,000 up to $5,000 and jail time of 48 hours up to 1 year. Like in DUI cases, the offender must enroll and complete ADSAP training within 1 year from sentencing. For “Great bodily injury” cases, the fine is $5,000 to $10,000 and not less than 30 days in jail up to 15 years. Where death results, the fine is $10,000 to $25,000 and not less than 1 year up to 25 years in prison.

Lawyer: State senator should resign if he lied about crash

The lawyer for a woman whose car was hit by a state senator charged with driving under the influence said Tuesday that the lawmaker should resign if he lied to state troopers. Attorney Matt Yelverton and the woman whose car Sen. Paul Campbell crashed into Saturday night on Interstate 26 near Charleston held a news conference as a fender bender turned into one of the most closely watched wrecks in South Carolina in years. The intrigue increased significantly after troopers also charged Campbell and his wife with providing false information. Michaela Caddin said Tuesday that after the crash, Campbell’s Mercedes pulled off the highway in front of her and she watched as Campbell got out of the driver’s side, his wife got out of the passenger seat and they switched places. “I was raised to believe that ethics, honesty and accountability are important,” the 21-year-old administrative worker said, reading from a statement. Campbell has insisted in several interviews that he was not driving and he expects the truth to come out at trial. Campbell’s attorney, Andy Savage, didn’t respond to an email message after Tuesday’s news conference. There are cameras along the interstate near the crash and Yelverton said he would like to see the footage, but none has been released. When Caddin was asked what she wanted out of Campbell, her lawyer said she wanted the senator to take responsibility for his actions and be held to a higher standard for honesty because of his public position. “Personally, I think a public official, if in fact, lied to law enforcement, he should resign,” Yelverton said. Both charges against Campbell are misdemeanors, and senators can only be automatically suspended when charged with felonies. He also is chief executive of the authority that runs the Charleston International Airport.
