Prominent Charleston Attorney Popped On DUI, Drug Charges – FITSNews

LAWYER, TV ANALYST ARRESTED. One of the most prominent attorneys in the South Carolina Lowcountry was busted for driving under the influence and drug possession over the New Year’s holiday. Mark Peper of the Peper Law Firm in Charleston, S.C. was arrested early Monday morning and charged with DUI, open container and cocaine possession, according to Charleston County jail records. He refused a field sobriety test, according to police, and allegedly told the arresting officer that the pants he was wearing containing trace elements of cocaine belonged to his brother. The 38-year-old lawyer was booked shortly before 2:00 a.m. EST at Charleston’s Al Cannon Detention Center and released on his own recognizance after posting a nearly $5,000 bond on the three charges. In addition to running ads all over the region for his successful law firm, he has appeared as an analyst on the Lowcountry’s most widely viewed television station, WCSC TV-5. Obviously this website has a different view than most establishment media outlets when it comes to recreational drug use, but Peper’s decision to get behind the wheel of a car while impaired – if that’s indeed what happened here – is most disappointing. Thankfully, no one was injured as a result of his carelessness – and our hope is that he will learn his lesson and get his life back on track quickly.

Compare Top DUI & DWI Attorneys

Driving under the influence means operating a motor vehicle after consuming alcohol or drugs that have impaired a person’s mental or motor skills. In most states, a person will be considered “Impaired” if they exhibit objective signs of intoxication, or if they have a blood alcohol content of.08 or higher. Many states also have zero tolerance laws for drivers under 21, where any non-zero BAC level constitutes an offense. Most states also hold commercial drivers, such as truck drivers, to a more rigorous standard. Law enforcement officers use a variety of tests, such as field sobriety tests and breathalyzers, to determine whether a driver is impaired by alcohol. In some jurisdictions, you have a right to refuse some of these tests, but in other jurisdictions you may be required to submit to them. It is important to know the law in your particular state, and to consult a DUI attorney if you are facing charges. DUI lawyers are criminal defense attorneys focused on representing clients facing DUI/DWI/OWI charges. An experienced DUI lawyer will be able to evaluate the case against you and present your options on how to best limit the impact of the charges against you. DUI lawyers also handle related cases such as driver’s license reinstatement and DUI record expungement. Blood Alcohol Concentration: The percentage of alcohol in a person’s blood. Field Sobriety Test: Any one of several roadside tests that can be used to determine whether a driver is impaired.

South Carolina DUI Laws

From Myrtle Beach to Charleston, Columbia to Greenville, drinking alcohol or taking illegal drugs and driving is a crime in South Carolina. The law surrounding a South Carolina driving under the influence crime is actually broken down into two, separate crimes: a DUI and a Driving with Unlawful Alcohol Concentration. “If you’ve been drinking alcohol, the alcohol goes into your bloodstream and is able to be measured by law enforcement through a blood or breath test. If your blood alcohol concentration is 0.08 percent or more at the time of driving, you will be in violation of the law. This is true even if you don’t feel”drunk” or “intoxicated. To be clear, this charge doesn’t involve driving while using drugs, strictly alcohol use. If you’ve been arrested and convicted of a DUI in the past, you’ll want to be aware of this rule. Simply put, if you’ve been convicted of a South Carolina DUI in the past 10 years, the prosecution will “Lookback” at your past DUI criminal history and elevate any DUI crimes charged against you. It will also be used by the sentencing judge at the time he or she is rendering a sentencing against you and may involve a higher fine, longer jail sentence, and possible installation of an ignition interlock device. If you need a Charleston DUI lawyer, then you are probably looking at hiring a lawyer or using a public defender. Driving under the influence, or drunk driving, means that you were caught driving a motorized vehicle while you had a blood alcohol level that exceeded the legal limits. This also applies to any other drug that may affect your ability to safely operate a car. If you are accused of DUI in Charleston, SC, the first thing you need to do is to secure a Charleston DUI attorney. These are, most commonly, a criminal defense lawyer. DUI Checkpoints Legal in South Carolina

A DUI checkpoint is when the police stop vehicles on public roadways to determine whether the driver is operating his or her vehicle under the influence. Many individuals believe that the police have to have probable cause in order to stop drivers at a DUI checkpoint. What the U.S. Supreme Court stated is that the dangers associated with drunk driving actually outweigh the degree of intrusion of sobriety checkpoints. As a result of this decision, the National Highway Safety Transportation Board has issued guidelines for law enforcement to follow when they decide to administer a sobriety checkpoint. The guideline that is essential for law enforcement to follow is that they have to make the sobriety checkpoint publicized far in advance. Sobriety checkpoints are legally permitted within the state of South Carolina. Otherwise, evidence obtained at the DUI checkpoint may be kept out of court. Cars Must Be Stopped in a Predictable Pattern – Law enforcement can’t stop vehicles randomly. The Site Must Be Safe and Identifiable – Law enforcement must take safety precautions such as proper lighting, warning signs, and signals. The checkpoint must be identified as a license or a DUI checkpoint. Police officers involved in the checkpoint must be in uniform. The Stop Must Be Brief – Law enforcement can’t hold drivers longer than is needed. The Checkpoint Must Be Effective – The prosecution must show evidence that the checkpoint “Served the public’s interest.” If you are stopped at a DUI checkpoint, you must provide your driver’s license, your registration, and your proof of insurance. If you have been charged with a DUI at a checkpoint, you may have several defenses.
